39th District Court-Landlord Tenant
Filing a Landlord/Tenant Case  - One Defendant

Provide to Court:
 
  • SUMMONS Packet
  • COMPLAINT Packet
  • Original NOTICE TO QUIT (7 OR 30 DAY) plus 3 copies
  • 3 copies of the Lease, Rental Agreement, Land Contract or Sheriff’s Deed
  • Check made payable to “39th District Court” for the filing fees (see schedule below)

             The plaintiff is not required but may wish to provide:

  • A self-addressed stamped envelope for landlord w/proper postage
  • A stamped envelope addressed to the defendant w/proper postage

Filing a Landlord/Tenant Case - Two or more Defendants

Provide to Court:
 
  • SUMMONS Packet per defendant
  • COMPLAINT Packet per defendant
  • Original NOTICE TO QUIT (7 OR 30 DAY) plus 5 copies and for each defendant  thereafter, 2 additional copies per defendant
  • Copy of Lease, Rental Agreement, Land Contract or Sheriff’s Deed plus 4 copies
    and each defendant thereafter 2 additional copies
  • Check made payable to “39th District Court” for the filing fees (see schedule below)

             The plaintiff is not required but may wish to provide:

  • A self-addressed stamped envelope for landlord w/proper postage
  • A stamped envelope addressed to each defendant w/proper postage

All Forms of Payment are accepted for Filing Fees.  Filing Fee Checks should be made Payable to:  39th District Court

Landlord/Tenant Filing Fees - possession only  $55.00
Possession and Money Damages (Supplemental Complaint)

$1 to $600 $90.00 $1,751 to $10,000 $130.00
$601 to $1,750 $110.00 $10,001 to $25,000 $215.00
**There is also a $20.00 Motion Fee on all cases to be paid at the time motion is filed** Landlord/Tenant Service Fees (as of Oct 01, 2014)
$27.00 Roseville per Defendant
$28.00 Fraser per Defendant
 Any party other than the plaintiff may serve the defendant(s).  Failure to provide timely proof of service may delay the case.
 
If the plaintiff wishes to arrange service through the court:
 
       ***All Service Fees must be paid Separately From Filing Fees (effective January 02, 2004)***
 
  
Service Fees must be paid separately by Check, Money Order or Cashier’s Check.  No Cash or Credit Cards.

PURSUANT TO MICHIGAN LAW
•   LLC/CORPORATION  Must be represented by a lawyer (not a manager or owner) 
•   D/B/A's (doing business as)  Must be represented by Owners or Lawyers only 
•   PRO PER PLAINTIFFS  Must prepare their own judgments
